We are committed to respecting and protecting the privacy rights of our Customers and their clients ("Clients"). This Privacy Policy provides information on our policies and procedures regarding the collection, use, and disclosure of personal information we receive relating to Customers or Clients, whether from Customers or directly from Clients. We are not responsible for our Customers' use of Clients' information, and disclaim any liability related thereto.
We also process personal information of users of our website, https://www.assemblysoftware.com/, and any page where this Privacy Policy is posted (the "Site") using cookies or similar technologies for the purposes described in our Cookie Policy. Our Cookie Policy includes additional information about how we use cookies and how you can exercise your preferences about our use of these technologies.
This Privacy Policy, which is incorporated into our Terms of Service, may be updated from time to time. We will notify you of material changes by posting the updated Privacy Policy on our website(s). You are advised to consult this policy regularly for any changes.
By using or accessing our software or services in any manner, you, whether you are a Customer, a Client or Site user, acknowledge that you accept the practices and policies outlined in this Privacy Policy, and you hereby consent that we will collect, use, and share your information in the following ways.
Information Collected
In order to use our software and services, you may be required to provide certain personal and other information. We may store such information to provide you continued services. We may also store any content that you upload in order to make it available to you through our software and/or services.
The information we collect and/or store may be anonymous or information that is personally identifiable.
Anonymous Information is any information that cannot be tied back to a specific individual or household (including aggregated information). For instance, we may collect information about how many users access our Software or Site per day. We may also collect aggregated statistics, such as the number of cases all of our Customers have opened over a certain time period. Like most software providers, we automatically collect certain information, such as information relating to your technology infrastructure. This information, which doesn't identify individual users, helps us to analyze the usage of our software for purposes of improving our product or may be used to improve our software and/or service offerings and is not subject to this Privacy Policy. We may link some of this automatically-collected data to certain Personally Identifiable Information, which will be subject to this Privacy Policy.
Personally Identifiable Information is information that specifically identifies who one is, such as one's name, phone number, or address. We may collect such information in the ordinary course of our business, including to allow us to personalize our software or to perform certain services, or by virtue of you permitting access to your systems and/or databases for purposes of providing technical support. Personally Identifiable Information does not include information that is publicly available.
Access to our software is limited to those users authorized by each Customer. We do not access the content you enter into the software except in the following ways: (i) to provide technical support as requested or required; (ii) as compelled by a legal or regulatory authority; or (iii) on an aggregated, non-personally identifiable basis.
Some Personally Identifiable Information may also be provided to contractors and third parties who assist us in providing our software and services, but who are contractually obligated not to make use of any such information other than to assist us in providing our software and services. We do not rent or sell Personally Identifiable Information to third parties in connection with our software or services. However, our Site uses third-party advertising cookies, and the disclosure of personal information to advertising partners through those cookies may be considered a "sale" or "sharing" of personal information, or "targeted advertising," under US state privacy laws. You can opt out of this activity as described in the "Your Privacy Rights" section below and through the cookie settings control on our Site. We do not have actual knowledge that we have sold the Personal Identifiable Information of users we know are less than 16 years of age.
We may disclose aggregate statistics as a measure of interest in and/or use of our software and/or services, to third parties in the form of aggregate data, such as overall patterns or reports that do not describe or identify any individual Customer.
We use personal information primarily for the purposes of account set-up, monitoring, modifications, upgrades, and communications related to our software and services. We may use your email address, mailing address, and/or telephone number to contact you or to send you information regarding our software and/or services, and/or to respond to inbound inquiries from you.
We may also use personal information for the following business and operational purposes:
- To provide, operate, maintain, secure, troubleshoot, and improve the Site.
- To analyze Site usage, improve user experience, conduct testing and optimization, and evaluate the Site's performance.
- To send service-related communications and, where permitted, marketing or informational communications about Assembly Software products, services, events, and updates.
- To protect the rights, property, safety, and security of Assembly Software, Customers, users, Clients, and others; prevent fraud, abuse, and misuse; and comply with legal, regulatory, contractual, and enforcement obligations.
We will request opt-in consent for use of any automated text messaging for marketing purposes. If at any time you would like to opt-out of text messages, reply STOP to the number you received the message from.
We may retain an archived copy of your records as required by law or for legitimate business purposes.

You must prevent unauthorized access to your account and Personal Information by selecting and protecting your password appropriately and limiting access to your computers or devices and browsers by signing off after you have finished accessing your account.
Your Privacy Rights
Depending on your state of residence, US state privacy laws may give you rights over the personal information we control about you. These rights apply to personal information for which Assembly Software determines the purposes and means of processing. For example, information about visitors to our Site and our own business contacts. For personal information that our Customers upload to or store in our software about their own Clients, Assembly Software acts only as a service provider or processor on the Customer's behalf; if you are such a Client, please direct your privacy requests to the relevant Customer (for example, the law firm), who is responsible for responding.
Subject to the limits and exceptions in applicable law, you may have the right to: (1) confirm whether we process your personal information and access it; (2) correct inaccurate personal information; (3) delete your personal information; (4) obtain a portable copy of the personal information you provided to us; (5) opt out of the sale or sharing of your personal information and of its use for targeted advertising; (6) opt out of certain profiling; and (7) limit our use and disclosure of sensitive personal information. We will not deny you goods or services, charge you a different price, or provide you a different level of service because you exercised any of these rights.
To exercise these rights, contact us at privacy@assemblysoftware.com. We will verify your request and respond within the time the applicable law allows, and you may use an authorized agent to submit a request on your behalf. To opt out of the sale or sharing of personal information and of targeted advertising, you may also use the cookie settings control on our Site. We honor the Global Privacy Control (GPC) and other recognized universal opt-out preference signals sent by your browser or device, and treat them as a valid opt-out request for that browser or device.
If we decline to act on your request, we will tell you why. Based on your state of residence, you may appeal that decision by contacting us at privacy@assemblysoftware.com. We will respond to authorized appeals within the time the applicable law allows. If your appeal is denied, you may submit a complaint to your local privacy authority (e.g., the attorney general of your state).

If you believe a child under 13 has provided personal information to us through our Site, please contact us at privacy@assemblysoftware.com so that we can take appropriate action.
